These Terms and Conditions (“Terms”) govern access to and use of the Aquaviva Academy website and all services provided by Aquaviva Academy.

By accessing this website, submitting an enquiry, registering for training, purchasing services, or making a donation, you agree to be bound by these Terms. If you do not agree, you must not use this website or our services.

1. Definitions

In these Terms:

  • Aquaviva, Aquaviva Academy, we, us, or our means Aquaviva Academy.

  • You or your means any individual or entity accessing the website or using our services.

  • Services means training, education, consulting, coaching, workshops, resources, or related services provided by Aquaviva Academy.

  • Website means the Aquaviva Academy website and any associated platforms.

  • Content includes all materials, text, resources, presentations, videos, documents, and intellectual property provided by Aquaviva Academy.

2. Nature of Services

Aquaviva Academy provides education, professional development, and consulting services primarily to individuals and organisations operating in the Disability and Human Services sectors.

Aquaviva Academy:

  • Is not an NDIS registered provider

  • Does not provide NDIS funded supports or services

  • Does not act as a substitute for regulatory, clinical, legal, or organisational decision-making

All services are delivered for educational and capability-building purposes only.

3. Website Use

You agree to use the Website lawfully and must not:

  • Breach any applicable laws or regulations

  • Interfere with the operation or security of the Website

  • Attempt unauthorised access to systems or data

  • Copy, scrape, reproduce, or distribute Website content without permission

  • Use the Website for misleading, deceptive, or harmful purposes

  • Upload viruses or harmful or inappropriate data to our Enquiry form

We reserve the right to suspend or terminate access without refund and/or press charges where misuse is identified and causes/attempts to cause legitimate harm to the business.

4. Information and General Advice Disclaimer

All Content and Services are provided for general informational and educational purposes only.

Nothing provided by Aquaviva Academy:

  • Constitutes legal, clinical, medical, financial, or regulatory advice

  • Replaces professional judgement, organisational policy, or statutory obligations

  • Guarantees compliance, accreditation, or regulatory outcomes

You remain solely responsible for how information is interpreted, implemented, or relied upon.

5. Scope

Scope: The scope, deliverables, timelines, and fees for Services will be agreed in writing prior to commencement.

Variations: Any variation to Services must be agreed in writing. Aquaviva Academy may adjust delivery methods where reasonably required.

No Guarantee of Outcomes: While Services are evidence-informed and delivered with due care and skill, outcomes depend on multiple external factors and are not guaranteed.

6. Fees, Invoicing and Payment

Fees are quoted in Australian dollars unless otherwise stated

  • Payment terms are specified at the time of booking or engagement

  • Invoices must be paid by the due date

  • Late or non-payment may result in suspension or termination of Services

Aquaviva Academy reserves the right to recover reasonable costs incurred in relation to unpaid invoices..

7. Cancellations, Refunds and Rescheduling

Unless otherwise agreed in writing:

  • Cancellations with insufficient notice may incur a cancellation fee

  • Rescheduling is subject to availability

  • Aquaviva Academy may reschedule Services due to unforeseen circumstances

Refunds are provided only where required under Australian Consumer Law.

8. Donations

Where Aquaviva Academy accepts donations:

  • Donations are voluntary

  • Donations do not constitute payment for Services

  • Donations are non-refundable unless required by law

  • Tax treatment is the responsibility of the donor unless otherwise stated

9. Intellectual Property

All Content remains the intellectual property of Aquaviva Academy unless otherwise agreed in writing.

You must not:

  • Copy, record, distribute, sell, or reproduce Content

  • Share materials outside the purchasing organisation

  • Use Content for commercial purposes without written consent

Unauthorised use may result in legal action.

10. Confidentiality

Both parties agree to maintain confidentiality of information disclosed during Services, except where:

  • Disclosure is required by law

  • There is a serious and imminent risk to health or safety

  • Disclosure is authorised in writing

11. Privacy

Personal information is handled in accordance with our Privacy Policy, which forms part of these Terms.

By using the Website or Services, you consent to the collection and use of personal information as described in that policy.

12. Limitation of Liability

To the maximum extent permitted by law:

  • Aquaviva Academy is not liable for indirect, incidental, special, or consequential loss

  • Liability is limited to the amount paid for the relevant Service

  • We are not responsible for actions taken or decisions made based on Content or Services

Nothing in these Terms excludes rights under Australian Consumer Law.

13. Indemnity

You agree to indemnify Aquaviva Academy against all claims, losses, damages, or expenses arising from:

Aquaviva Academy is not responsible for:

Termination does not affect accrued rights or obligations.

17. Governing Law

These Terms are governed by the laws of South Australia, and the courts of South Australia have exclusive jurisdiction.
